1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the A Wealth And Knowledge Education Network platform, website, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

Where access is provided through a school, these Terms apply to the school as the subscribing institution and to all authorised users, including teachers, administrators, and students. Schools are responsible for ensuring that their staff and students are aware of and comply with these Terms.

2. About the Platform

A Wealth And Knowledge Education Network provides curriculum-aligned financial literacy education for Australian school students in Years 7 to 10. The Platform includes video lessons, structured learning modules, quizzes, case studies, and supporting educational materials across nine financial topics.

The Platform is designed for educational purposes only. It does not provide personal financial advice, investment advice, tax advice, or any other form of professional advice. Please refer to our Disclaimer for further details.

3. Eligibility and Access

The Platform is intended for use by Australian schools and their authorised users. Access may be granted through:

• School subscriptions — schools or education institutions that enter into a subscription agreement with us
• Trial or demo access — schools that request a demonstration or trial period through our contact form
• General website access — visitors browsing publicly available pages of our website

Student access is provided exclusively through their school. Students under the age of 18 must access the Platform under the supervision and authorisation of their school. We do not offer direct accounts to individual students or members of the public.

4. School Responsibilities

Schools that subscribe to or access the Platform agree to the following responsibilities:

• Ensuring that all users accessing the Platform through their institution are authorised to do so
• Obtaining any necessary consent from parents or guardians for student use of the Platform, in accordance with their school’s policies and applicable privacy legislation
• Supervising student use of the Platform in a manner consistent with their duty of care obligations
• Keeping account credentials secure and notifying us promptly of any unauthorised access
• Ensuring that Platform content is used in accordance with these Terms and any applicable licence agreement

5. Acceptable Use

When using the Platform, you agree not to:

• Use the Platform for any purpose other than educational use within an Australian school setting, unless otherwise agreed in writing
• Copy, reproduce, distribute, publish, or commercially exploit any content from the Platform without our prior written consent
• Share, transfer, or provide access credentials to any unauthorised person
• Attempt to gain unauthorised access to any part of the Platform, its servers, or any connected systems
• Use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party’s use
• Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, or otherwise objectionable
• Use any automated tools, bots, scrapers, or similar technologies to access or extract content from the Platform
• Remove, alter, or obscure any copyright notices, trademarks, or other proprietary markings on the Platform

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, videos, audio, quizzes, case studies, curriculum mappings, and software, is the intellectual property of A Wealth And Knowledge Education Network or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Subject to a valid subscription or access agreement, we grant schools a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its content solely for internal educational purposes within their institution. This licence does not permit:

• Redistribution of content to other schools or institutions
• Commercial use or resale of any Platform content
• Creation of derivative works based on Platform content
• Use of Platform content beyond the scope of the subscribing institution’s agreement

7. User-Generated Content

The Platform may allow users to submit content such as quiz responses, case study answers, and contact form messages (“User Content”). By submitting User Content, you grant us a non-exclusive, royalty-free licence to use, store, and process that content for the purpose of providing and improving our services.

You retain ownership of your User Content. We will handle all User Content in accordance with our Privacy Policy, with particular care taken regarding student submissions.

8. Subscriptions and Payment

Access to certain features of the Platform requires a paid subscription. Subscription terms, pricing, and payment conditions are set out in the individual subscription agreement between us and the subscribing school or institution.

• All fees are quoted in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise
• Payment terms are as specified in the subscription agreement
• We reserve the right to modify pricing for future subscription periods with reasonable notice
• Failure to pay fees may result in suspension or termination of access

9. Availability and Modifications

We strive to keep the Platform available at all times but do not guarantee uninterrupted or error-free access. We may, without prior notice:

• Temporarily suspend access for maintenance, updates, or security reasons
• Modify, update, or remove content on the Platform to ensure accuracy and relevance
• Add, change, or discontinue features or functionality of the Platform

We will make reasonable efforts to notify subscribing schools of any significant changes that may affect their use of the Platform.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

11. Disclaimer of Warranties

To the maximum extent permitted by Australian law, the Platform and its content are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, whether express, implied, or statutory, including but not limited to:

• The accuracy, completeness, reliability, or currency of any content on the Platform
• That the Platform will meet your specific requirements or expectations
• That the Platform will be uninterrupted, timely, secure, or free of errors or defects
• That any content on the Platform constitutes professional financial, legal, or tax advice

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

12. Limitation of Liability

To the maximum extent permitted by law, A Wealth And Knowledge Education Network, its directors, employees, contractors, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or anticipated savings
• Loss or damage arising from reliance on any content provided on the Platform
• Loss or damage resulting from unauthorised access to or alteration of your data

Where our liability cannot be excluded, our total aggregate liability to you for all claims arising from or in connection with these Terms or your use of the Platform shall not exceed the total fees paid by you (or your school) to us in the twelve (12) months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless A Wealth And Knowledge Education Network and its directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms
• Your misuse of the Platform
• Your violation of any applicable law or regulation
• Any claim by a third party resulting from your use of the Platform

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, including but not limited to:

• Breach of these Terms or any applicable subscription agreement
• Non-payment of subscription fees
• Conduct that we reasonably believe is harmful to other users, the Platform, or our business

Upon termination, your right to access and use the Platform ceases immediately. We will handle any personal information in accordance with our Privacy Policy and applicable data retention obligations.

Schools may terminate their subscription in accordance with the terms of their subscription agreement. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall continue in effect.

15. Third-Party Links

The Platform may contain links to third-party websites or resources for educational reference. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. You access third-party links at your own risk.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Victoria.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated revision date. For subscribing schools, we will provide reasonable notice of material changes that affect their use of the Platform.

Continued use of the Platform following any changes constitutes acceptance of the revised Terms. If you do not agree with any changes, you must discontinue use of the Platform.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving its original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and any applicable subscription agreement, constitute the entire agreement between you and A Wealth And Knowledge Education Network regarding your use of the Platform. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
